What records may be restricted

By Maryland law

Maryland's PIA generally favors disclosure. However, certain categories of records may be withheld in whole or in part to protect privacy, investigations, or legally privileged information. Common restrictions include:

Personnel records of public employees

Performance evaluations, disciplinary records, personal information, and home contact details are generally restricted. Public-facing position details and salary information are disclosable.

Active investigations

Records compiled for law enforcement, judicial, or quasi-judicial proceedings may be withheld during active investigation if disclosure would interfere with enforcement.

Attorney-client privileged communications

Communications between the City and its attorneys regarding pending or contemplated litigation are protected by attorney-client and work-product privilege.

Personal identifying information

Social Security numbers, financial account information, medical records, and similar personal data are redacted from otherwise disclosable records.

Trade secrets and confidential commercial or financial information from third parties is protected, including portions of competitive bid documents.

Records that could compromise critical infrastructure security, such as detailed water system configurations or cybersecurity vulnerabilities, may be withheld.

Even when records are restricted, we will explain which exemption applies and, where possible, provide a redacted version with the protected portions removed. Denials can be appealed to the Maryland Public Access Ombudsman.
